These Terms of Service govern use of fairmaxlaw.com, its contact forms, debt calculator, and related online intake features provided by Fairmax Law PLLC (“Fairmax Law,” “we,” “us,” or “our”). Section 5 contains the terms for our optional transactional SMS program.
These are website and messaging terms. They do not set the scope or price of legal representation, authorize a payment, or replace a separate engagement or payment agreement.
Our Privacy Policy explains how personal information is handled. Use of this website or acceptance of these terms does not, by itself, authorize text messages.
Our website provides information about Fairmax Law and its legal services. General website material, calculator results, and automated intake responses are informational and do not replace legal advice tailored to your circumstances.
Visiting the website, completing a form or calculator, requesting an appointment, or exchanging an initial message does not by itself establish an attorney-client relationship or require Fairmax Law to accept a matter. Representation and its scope are established through our engagement process and written agreement, subject to applicable law and professional obligations.
Information about a potential matter remains subject to any confidentiality duties that apply to prospective-client communications. Nothing in these terms waives those protections.
Please do not assume that an online submission means a filing, appearance, payment, or other legal action has been completed. Confirm time-sensitive matters directly with the team handling your inquiry or representation.
A confirmation screen, automated reply, appointment request, or delivery indicator does not by itself confirm that an attorney has reviewed a matter, agreed to act, or completed a requested action. If a submission appears to fail or a response has not arrived, contact our team through the published contact information rather than assuming it has been handled.
For filings, service of documents, formal notices, or deadline-sensitive communications, follow the instructions for your matter and the applicable procedure. A general website form or SMS does not by itself establish that a procedural requirement has been satisfied. Nothing in this paragraph alters duties Fairmax Law has undertaken in an existing engagement.
Calculator outputs and online assessments depend on the information entered and are preliminary. They do not guarantee eligibility, a particular bankruptcy chapter, debt discharge, court approval, a fee, or any other result. An incomplete or inaccurate answer can affect an estimate or assessment.
Where automated or AI-assisted features are offered, an output can omit relevant facts, misunderstand an answer, or contain an error. Review the information you enter and ask our team to clarify anything material to your situation. An automated result does not establish that every relevant legal, factual, or financial issue has been considered.
Fees, costs, payment arrangements, and the work included in an engagement are established in the applicable written agreement. Website descriptions of payment options are subject to eligibility and the terms of that agreement. These website terms do not replace or modify an engagement agreement.
These terms do not create a refund rule, cancellation charge, recurring charge, or authorization to debit an account. Any payment or payment arrangement is handled under the separate instructions and agreement applicable to it.
Service availability depends on the matter, jurisdiction, attorney availability, and applicable professional rules. Information about prior results, testimonials, or examples does not promise a similar outcome.
Our Required Disclosures and Information About Bankruptcy provide additional information. Fairmax Law is a debt relief agency that assists people with bankruptcy relief under the Bankruptcy Code.
Please provide accurate information and use contact details that you are authorized to provide. If your contact information changes, notify us so communications reach the correct person.
If you assist another person, accurately identify your role and provide only information you are authorized to supply. Submitting information for someone else does not by itself establish authority to make decisions or grant consent for them. Our team may need to establish the appropriate person’s instructions or authority before acting on a request. Do not use your own SMS consent to enroll another person.
Use our website and intake tools for lawful inquiries and authorized purposes. Do not submit deceptive inquiries, impersonate another person, upload malicious material, attempt to access someone else’s information, bypass access controls, or interfere with the operation of the website or its services.
Do not use contact forms to send spam, harvest other users’ information, or conduct unauthorized automated activity that compromises access, confidentiality, or system availability. These restrictions do not limit activity permitted by applicable law.
If you use a portal account, protect your sign-in information and promptly report suspected unauthorized access. Use the document-delivery method our team provides for sensitive records. Ordinary text messages and initial contact forms are not appropriate places for passwords, full financial account numbers, or Social Security numbers.
Keep copies of important information you send and of any confirmation you receive. Ask our team about the appropriate record or delivery method for a matter; a public website form should not be your sole record of a required submission.
Verify unexpected requests for payments, changes to bank details, or requests for account credentials by contacting Fairmax Law through a previously known number or the contact details published on our website. Do not rely solely on the contact details in an unexpected message. Report a suspected impersonation or misdirected communication without forwarding sensitive documents unnecessarily.
Website text, graphics, logos, software, and other materials may be protected by copyright, trademark, or other rights held by Fairmax Law or other rights holders. Do not remove ownership notices or use material in a way that misrepresents its source, ownership, or endorsement. Obtain permission where your intended use requires it. Uses permitted by applicable law remain available.
The site may contain external links and embedded services, including intake tools, videos, maps, accessibility tools, and spam protection. Independently operated services may have their own terms and privacy notices. A link does not, by itself, mean Fairmax Law controls or endorses every aspect of that service.
A provider’s availability, pricing, services, or privacy terms may change. Review the information relevant to your use of an independently operated service. This paragraph does not remove any responsibility that Fairmax Law has for a provider acting on its behalf under applicable law or an engagement agreement.
Google reCAPTCHA is governed by the Google Privacy Policy and Google Terms of Service. Those Google documents apply to Google’s service and do not replace Fairmax Law’s own Privacy Policy or these terms.
When you affirmatively opt in, you agree to receive transactional SMS messages from Fairmax Law PLLC and its agents acting on its behalf at the mobile number you provide. Messages relate to your inquiry or requested legal services and may include inquiry responses, consultation or appointment confirmations and reminders, intake or document requests, and case or service updates. Messages may be sent using automated technology.
This program covers transactional communications. Enrollment does not authorize promotional text campaigns or messages from other businesses for their own purposes. Any separate marketing program requires the consent applicable to that program.
SMS consent is optional. Consent is not required to submit an inquiry, purchase anything, or obtain legal services. You may leave the SMS consent checkbox unchecked and still submit the form.
Web enrollment requires your affirmative selection of the separate, optional SMS consent checkbox. A preselected box does not constitute consent under this program. Any other offered enrollment method must involve and document an affirmative choice appropriate to that method. Providing a telephone number, submitting an inquiry, or accepting general website terms is not by itself enrollment in recurring text messages.
An agent operating the program for Fairmax Law acts on our behalf; that role does not permit the agent to transfer your consent or use it for its own texting program.
Message frequency may vary. Message and data rates may apply. Frequency depends on your interactions with Fairmax Law, appointment activity, and the needs of your inquiry or matter. Your mobile provider determines any messaging or data charges under your plan. Contact your provider about those charges.
Reply STOP to a Fairmax Law text message to opt out at any time. We will honor your request, and you may receive one message confirming the opt-out. After that confirmation, program messages will stop unless you affirmatively opt in again.
You may also tell us that you want to stop texts by calling 888-324-7629 or emailing he**@********aw.com. We will also honor other clear, reasonable requests to withdraw messaging consent as required by applicable law.
Opting out of SMS does not cancel an appointment, end an engagement, or prevent you from receiving services. Contact our team to arrange another way to receive necessary communications.
An opt-out may need to remain recorded to prevent further enrollment without a new affirmative choice. Correcting an account, resubmitting a general inquiry, or receiving updated website terms does not by itself reverse an SMS opt-out.
Reply HELP to a Fairmax Law text for assistance, or contact:
Only enroll a number you are authorized to use. Please notify us if your number changes or you stop controlling it. A new holder of a number does not inherit your consent. To rejoin after opting out, provide a new affirmative opt-in through an available enrollment method or contact us for assistance.
Message delivery depends on carrier networks, device compatibility, coverage, filtering, and other technical factors. Messages can be delayed, blocked, duplicated, or undelivered. No particular delivery time or uninterrupted availability is guaranteed by these terms. Do not rely on receipt of an SMS alone to confirm that a legal deadline has been met or an action has been completed; confirm important matters directly with the team handling your matter. Carrier services remain subject to their applicable terms and law.
Texts can be viewed by others with access to your phone, backups, or mobile account. Use the communication or document-delivery method our team provides for sensitive details.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. We do not sell or rent mobile numbers. We do not sell, rent, or transfer text messaging originator opt-in data or SMS consent to another business for its independent use. Providers may process information on our behalf to operate the messaging service, but may not use your consent for their own marketing. Legally required disclosures remain subject to applicable law.
Information about opt-ins and opt-outs is used to document and honor your choices and may need to be retained for that purpose. See our Privacy Policy for additional details about information handling and privacy requests.
Information can become outdated and technical interruptions can occur. Website information and tools are provided on an “as available” basis. A page, link, estimate, form, or automated response may contain an error or become unavailable. General website content does not promise suitability for a particular person’s circumstances or guarantee a legal, financial, or service outcome. Confirm information material to your matter with our team instead of relying solely on general website content or an automated result.
Website features may change or be unavailable for maintenance, security, or technical reasons. That does not, by itself, modify an existing engagement or remove duties owed in a matter. If access to a website feature prevents you from communicating with our team, use the published telephone or email contact information.
If a translation or accessibility feature produces an unclear or inconsistent statement, request clarification from our team. Do not assume an automated rendering resolves an ambiguity in a matter-specific document.
Nothing in these terms limits obligations owed under an engagement agreement, applicable professional rules, or law. These terms do not waive claims or remedies that cannot lawfully be waived.
We may revise these terms and will post the revised version with an updated date. We will provide additional notice or obtain new consent where required. Changes do not retroactively alter an engagement agreement or automatically expand the scope of your SMS consent.
If an applicable provision is determined to be unenforceable, the remaining provisions continue to apply to the extent permitted by law.
